A Brief on RTI-Act, 2005
The Right to Information Act 2005 (Act No. 22/2005) is a law enacted by the Parliament of India, giving citizens of India access to records of Central Govt. and State Govts. The Act applies to all States and Union Territories of India, except the State of Jammu and Kashmir - which is covered under a State-level law. Under the provisions of the Act, any citizen (including the citizens within J&K) may request information from a "public authority" (a body of Govt. or "instrumentality of State") which is required to reply expeditiously or within thirty days. The Act also requires every public authority to computerise their records for wide dissemination and to proactively publish certain categories of information so that the citizens need minimum recourse to request for information formally. This law was passed by Parliament on 15 June 2005 and came fully into force on 13th October 2005. Information disclosure in India was hitherto restricted by the Official Secrets Act, 1923 and various other special laws, which the new RTI Act now relaxes.

Payment details for seeking Information under RTI Act
The relevant provisions of the Act towards charging fee are as under:
  1. A request for obtaining information under Sub-section (1) of Section 6 shall be accompanied by an application fee of Rs.10.00 by way of cash against proper receipt or by demand draft or Indian Postal Order (IPO) in the name of the "The Director, Indian Institute of Chemical Technology" payable at Hyderabad, Telangana State.
  2. For providing the information under Sub-section (1) of Section 7, the fee shall be charged by way of cash against proper receipt or by Demand draft or Indian Postal Order (IPO) payable to the "Project Director, National Institute of Pharmaceutical Education & Research, Hyderabad” at following rates:
    a) Rs.2.00 for each page (in A4/A3 size paper) created or copied.
    b) Actual charge or cost price of a copy in larger size paper.
    c) Actual cost or price for samples or models; and
    d) For inspection of records, no fee for first hour; and a fee of Rupees 5.00 for each fifteen minutes (or fraction thereof) thereafter
  3. For providing the information under Sub-section (5) of Section 7, the fee shall be charged by way of cash against proper receipt or by Demand draft payable to the "The Director, Indian Institute of Chemical Technology" at following rates:
    a) information provided on CD Rs.50.00 per CD; and
    b) For information provided in printed from at the price fixed for such publication or Rs.2.00 per page of photocopy for extracts from the publications.

PARTICULARS OF ORGANIZATION, FUNCTIONS AND DUTIES

National Institute of Pharmaceutical Education & Research (NIPER), Hyderabad, in its brief journey since 2007,has established itself as a Centre of Excellence in Pharmaceutical Education and Research. Over the years, the Institute is well-equipped for carrying out advanced research in Pharmaceutical Sciences. In the last two years, there is a marked growth in the research activities of the Institute which is evident by the number of research papers published; awards and honours received by the students and faculty; research grants received from the various funding agencies, and also collaborative research programmes with reputed Institutes and Industries.
The contributions from the Mentor Institute, vis., CSIR-IICT, NIPER Faculty, Coordinators and Management and also various external Guest Faculty from reputed Industry and Academia is instrumental in accelerating the progress of the Institute.

Functions of the Institute
  • to nurture and promote quality and excellence in pharmaceutical education and research;
  • to concentrate on courses leading to Master’s degree, Doctoral and Post-Doctoral courses and research in pharmaceutical education;
  • to hold examinations and grant degrees’
  • to confer honorary awards or other distinctions;
  • to cooperate with educational or other institutions having objects wholly or partly similar to those of the Institute by exchange of faculty members and scholars and generally in such manner as may be conducive to their common objectives;
  • to conduct courses for teachers, pharmaceutical technologists, community and hospital pharmacists and other professions;
  • to collect and maintain world literature on pharmaceutical and related sciences and technology so as to develop an Information Centre of its own kind for other institutions within the country and in the developing world;
  • to create a central facility of pharmaceutical instrumentation and analysis for use by the researchers within and outside the Institute;
  • to have a centre to experiment and innovate and to train teachers and other workers in the art or science of pharmaceutical teaching;
  • to develop a world level centre for creation of new knowledge and transmission of existing information in pharmaceutical areas, with focus on national, educational, professional and industrial commitments;
  • to develop a multi-disciplinary approach in carrying out research and training of pharmaceutical manpower so that the larger interests of the profession, academic and pharmaceutical industry are better served and pharmaceutical work culture is evolved which is in tune with the changing world trends and patterns of pharmaceutical education and research;
  • to organize national or international symposia, seminars and conferences to selected areas of pharmaceutical education, from time to time;
  • to arrange courses catering to the special needs of the developing countries;
  • to act as a nucleus for interaction between academic and industry by encouraging exchange of scientist and other technical staff between the Institute and the industry and by undertaking sponsored and funded research as well as consultancy projects by the Institute; and
  • to pay due attention to studies on the distribution and usage of drugs by the rural masses, taking into account the socio-economic spectrum in the country.

NORMS FOR DISCHARGE OF FUNCTIONS

NIPER, Hyderabad is now on Project Mode and is being mentored by the Indian Institute of Chemical Technology (CSIR), Hyderabad. The Institute is being headed by one of the senior Scientists of the IICT, Hyderabad who are nominated by the CSIR-IICT and is designated as “Project Director”. More or less, the Institute is being run on the lines of CSIR-IICT with regard to its personnel management, financial dealings, etc. as applicable to staff members on working contractual basis. The Project Director, NIPER, Hyderabad, is assisted by a Dean and a couple of Course Coordinators as nominated by the CSIR-IICT. He is further assisted by a Registrar, Coordinator (Admn.) and Coordinator (S&P). The procurement of goods and services are undertaken in accordance with the CSIR Purchase Rules of Goods & Services, 2008 and CSIR Purchase Manual of Best Practices, 2008 The Institute receives constant guidance from the Department of Pharmaceuticals, Ministry of Chemicals & Fertilizers, New Delhi. It is further supported by the “Steering Committee” and also the “Academic Standards Committee” constituted for providing guidance and for building national character of the Institute and specifically identify marginalized social groups and suggest institutional measures for inclusion. To suggest measures for an efficient and effective transaction of Senate, Academic Planning and Development Committee, Laboratory Services, HR Policies, Consultancy services and transparency in all its activities

RULES, REGULATIONS, INSTRUCTIONS, MANUALS AND RECORDS FOR DISCHARGING FUNCTIONS

General : The Govt. of India set up National Institute of Pharmaceutical Education & Research (NIPER), SAS Nagar, Mohali, under NIPER Act, 1998 with a mandate to nurture and promote quality and excellence in pharmaceutical education and research in the country to make India a global pharma leader in Drug Discovery and Innovation. The NIPER Act, 1998 was subsequently amended by the NIPER (Amendment) Act, 2007, which inter alia, empowered the Central Govt. to establish similar Institutes in different parts of the country. In terms of the amended NIPER Act, 2007, the Central Govt. established new NIPERs at Hyderabad, Ahmedabad, Kolkata, Guwahati, PRaebareli and Hajipur.
Fountain-head of Powers : All the NIPERs of the country draw its sustenance functional independence from the National Institute of Pharmaceutical Education and Research Act, 1998 (No.13 of 1998). The activities of NIPERs are further guided by the Statutes, Ordinances and similar other communications by the Govt. of India.
Stores & Purchase Procedure : NIPER, Hyderabad adopted the CSIR Purchase Rules of Goods & Services, 2008 and CSIR Purchase Manual of Best Practices, 2008 through the Mentor Institute, viz., CSIR-IICT, Hyderabad.
Transfer of Technology : NIPER, Hyderabad follows the CSIR Procedure for Transfer of Technology and Knowledge-Base. NIPER, Hyderabad has been availing the technical services of CSIR-IICT, such as General Engineering, Civil Engineering, Chemical Engineering and similar other technical services.

  • External Committees

    Steering Committee : The Department of Pharmaceuticals, Ministry of Chemicals & Fertilizers, Govt. of India constitutes the various high level Committees for all the NIPERs in India. The Steering Committee till the Board of Governors for each NIPER is formed under the Chairmanship of the Secretary, Department of Pharmaceuticals.
  • Academic Standards Committee

    The Academic Standards Committee has been constituted under the Chairmanship of Prof. Seyed E. Hasnain, Professor of Biological Sciences, IIT, Delhi and Former Vice-Chancellor, University of Hyderabad, to bring about uniformity in the functioning of all the NIPERs to make these Institutes into international hubs of pharma education and research with various terms of reference.
     To suggest measures for an efficient and effective transaction of Senate, Academic Committee, Selection Committee, System of Recruitment of Faculty, HR Policies, Endowment chairs, Consultancy Services, Grievance Redressal system, Transparency, etc.
